TERMS AND CONDITIONS OF SALE

1. General – All goods and services are sold subject to these Terms and Conditions. By purchasing from Brumby Digital, the customer agrees to these terms.

2. Payment – Full payment is required before collection or delivery unless otherwise arranged in writing. Accepted payment methods include cash, bank transfer, or other approved methods. Ownership of goods remains with Brumby Digital until full payment is received.

3. Pricing and GST – All prices quoted are in Australian Dollars (AUD) and inclusive of 10% GST unless stated otherwise. Any quotation provided is valid for 7 days from the date issued unless withdrawn earlier.

4. Warranty – All new components are covered by the manufacturer’s warranty only. Brumby Digital provides a 30-day return-to-base warranty for system assembly workmanship. Warranty does not cover damage caused by misuse, improper installation, software faults, overclocking, power surges, or liquid damage. Data loss is not covered under any warranty claim; therefore, customers are responsible for maintaining backups.

5. Returns and Refunds – Returns are accepted only for faulty items covered under warranty. Change-of-mind returns are not accepted for custom-built systems. Returned items must include all original packaging, accessories, and proof of purchase.

6. Software and Licensing – Any operating systems or software installed are genuine and licensed. Brumby Digital is not responsible for license misuse or breach once delivered to the customer.

7. Liability – Brumby Digital shall not be liable for any indirect, incidental, or consequential loss, including data loss or downtime. Maximum liability is limited to the value of the goods or services supplied.

8. Data Handling and Privacy – Any customer data provided for repair or support services will be handled confidentially. Brumby Digital may securely erase data during service unless instructed otherwise.

9. Collection and Delivery – Risk of loss passes to the customer upon collection or delivery. Any delivery times provided are estimates and not guaranteed.

10. Governing Law – These Terms and Conditions are governed by the laws of Western Australia. Any disputes will be handled in the jurisdiction of the WA courts.

These Terms and Conditions of Sale commence on 10 October 2025

and remain in effect until amended or replaced by Brumby Digital.
